The Physician Payments Sunshine Act (Bill S. 301) and similar copy-cat state legislation requires manufacturers of drugs and medical supplies to report payments made to physicians. Payments are defined as any transfer of value, including promotional products.
While the law allows for transfers of value up to $100 over the course of an entire year, once that $100 mark is reached, every promotional product regardless of the value of the individual item will have to be reported.
The reality is that if every item must be reported, many companies will choose to give nothing of value rather than report on each item.
